Terms and Conditions

Article 1. General

1.0 These terms and conditions are a translation of the original Dutch text. In case of a dispute over the interpretation of the text, the Dutch text will serve as the original and binding text.

1.1 Micro-step.nl is part of Micro Step BV. Therefore, the terms and conditions of Micro Step BV are applicable on all orders.

1.2 By placing an order you agree with the terms and conditions.

1.3 Micro Step BV is registered under number: 74432370 at the Dutch Chamber of Commerce.

1.4 On all our conditions Dutch law is applicable.

1.5 All disputes between parties will be submitted to the competent court in the Netherlands.

Article 2. Agreement

2.1 We reserve the right to change prices and texts. Our offers and texts are therefore without obligation.

2.2 A contract is only concluded after acceptance of your order by. Micro Step BV is entitled to refuse orders or attach certain conditions to the delivery, unless otherwise specified. An agreement exists only when we have confirmed the order.

Article 3. Information

3.1 The content of this site and the content of all other expressions of Micro Step BV have been compiled with the greatest care. We can not provide any guarantees regarding the nature, accuracy or content of this information. Micro Step BV is not liable for any errors or inaccuracies or for the consequences of using the information.

3.2 We accept no liability for the content of other related sites to which there is a hyperlink or otherwise.

3.3 For misunderstanding, delays or transmission of orders and messages resulting from the use of the Internet or other communication between you and Micro Step BV or between Micro Step BV and third parties, as it relates to the relationship between you and Micro Step BV, Micro Step BV is not liable, except in case of intent or gross negligence by Micro Step BV.

Article 4. Prices and payments

4.1 All our prices are in euros, including VAT and excluding treatment and shipping, taxes or other charges, unless stated otherwise or agreed in writing.

4.2 Payment is made prior to delivery.

4.3 All offers are without obligation Micro Step BV. Micro Step BV reserves the right to change prices, especially when this is necessary due to (legal) regulations. Prices of outstanding orders will be executed at the old price.

4.4 Prices are subject to errors. If prices have been incorrectly marked, Micro Step BV reserves the right to terminate the agreement.

Article 5. Quotations

5.1 Quotations are free, unless otherwise stated in the offer.

5.2 Upon acceptance of an offer by the buyer, Micro Step BV reserves the right to revoke or deviate the offer within 3 days of receipt of such acceptance.

5.3 Verbal agreements Micro Step BV only will become definite after they have been expressly confirmed in writing.

Article 6. Delivery

6.1 Delivery takes place while stocks last.

6.2 If you want to have the products delivered to an address specified by you, we will deliver the products to you.

6.3 The order can also be picked up by the buyer at the pickup location.

6.4 The shipping will be charged at the prevailing rate. This rate is stated on the website and mentioned during the order process.

6.5 The delivery time is 30 days. If the agreed delivery period is exceeded for any reason then the buyer has the right to terminate the agreement and any payments made will be refunded to the buyer within 14 days.

6.6 All delivery periods mentioned on the website are indicative. No rights can be derived from them.

6.7 Incorrectly supplied or defective products can be exchanged free of charge. You pay no shipping.

Article 7. Retention of property

The delivered goods will only become your property when all that is due to Micro Step BV under the sales agreement has been met. The risk in respect of the products will be yours as soon as the products have been delivered.

Article 8. Guarantee and reclames

8.1 The warranty terms and conditions are always identical to those the manufacturer uses for the product. Should there be a warranty claim, a valid proof of purchase is needed. Warranty claims are handled by appointment.

8.2 Micro Step BV uses the warranty provisions as established by the manufacturer. Warranty claims on Micro Mobility products are assessed by Micro Step BV and Micro Mobility Systems Ltd. in Switzerland. In case of any doubt about warranty the view of Micro Mobility Systems Ltd. will be decisive.

8.3 Limited Warranty applies to wear parts such as brakes, bearings, wheels, grips, pedals, saddles and similar products. Warranty here is only applicable if the complaint can not possibly have been caused by its use.

8.4 The guarantee does not apply if the defect is due to 1. carelessness, 2. deliberate damage, or 3. inattention.

8.5 Warranty will expire if other then designated by the manufacturer's service or repair services or other work on the article has been committed. 

8.6 You have the obligation to examine whether the products meet the agreement upon delivery. You must notify Micro Step BV if this is not the case, as soon as possible and at least within seven (7) days after delivery, when discovery was reasonably possible to give written reasoned knowledge.

8.7 If it is demonstrated that the products do not comply with the agreement, Micro Step BV has the choice for the products to be returned and replaced by new products or to refund the invoice value.

Article 9. Returns

9.1 If you do not want to be a product for any reason whatsoever to take off, you have to notify Micro Step BV within 30 days in writing. After that you have 14 days to return the product(s).  The return shipping costs are for your account.

9.2 If the product is complete, in original and undamaged packaging and in unused condition, we will refund the purchase price you paid including shipping to your account as soon as possible

9.3 There is no entitlement to refund if the item has been used or damaged, or the order is opened or not returned in the original packaging.

Article 10. Personal Information

10.1 Your privacy is very important to us. Micro Step BV respects the privacy of all users of the site and ensures that all your personal data are confidential and will not be disclosed to third parties other than strictly necessary for the processing of orders, payments and shipments.

10.2 The personal data are processed by Micro Step BV within the rules of the Data Protection Act. Micro Step BV uses this for the processing of the contract, to fulfill the warranty obligations, provide excellent service, and provide the customer with product information and personalized offers. Appeals against this processing for direct mailing by the customer will be honored by Micro Step BV.

Article 11. Force majeure

11.1 Micro Step BV is not liable if and when agreements can not be fulfilled due to force majeure.

11.2 Force majeure shall mean any strange reason and any circumstance which risk should not be reasonable. Delay or failure by our suppliers, transport problems, strikes, government measures, delays in supply, omissions of suppliers and / or manufacturers of Micro Step BV , as well as from individuals, disease, defects in appliance or shipment are explicitly force majeure.

11.3 Micro Step BV reserves in case of force majeure the right to suspend its obligations and is entitled to dissolve the agreement in whole or in part, or to claim that the content of the agreement is amended as detailed as possible. Micro Step BV is in no way obligated to pay any penalty or damages

Article 12. Disclaimer

12.1 Micro Step BV tries to present the information on the site as carefully and current as possible. We reserve the right to change the content of this information. If any errors occur in the data or if the information is no longer current, we accept no liability for the consequences.

12.2 Despite the greatest possible care, the colors of a product shown on the website may deviate from the actual color.

12.3 We can also accept no liability if there might be errors or delays in the provision of information. Micro Step BV does not warrant that e-mails or other electronic messages sent to her will be received and processed in time, and assumes no liability for the consequences of non or late receipt or process.

12.4 We accept no liability for the content of sites to which there is a hyperlink or otherwise.

12.5 Claims with respect to compensation for expenses caused by injury, damaged scooter or accessories etc. are excluded. This liability is at all times limited to the amount of the invoice.

12.6 When Micro Step BV has allowed deviations from these conditions for any length of time, this shall not affect its right to demand immediate and strict compliance with these conditions. You can never claim any right by virtue of the fact that Micro Step BV applies these conditions smoothly.
